Draft Weights & Measures Regulations

PUBLIC NOTICE

 

The Wyoming Department of Agriculture is proposing to promulgate new Chapter 18 rules, Weights & Measures, Metrology Laboratory and Registered Service Technicians; and repeal Chapter 15, Checkweighing Prepackaged Commodities Regulations; repeal Chapter XVIII Specifications, Tolerances and Testing Procedures for Weighing Devices; and repeal Chapter XX Regulations for Registration of Weighing & Measuring Device Service Technicians.  Copies of the proposed rules are available at the Wyoming Department of Agriculture 2219 Carey Avenue, Cheyenne, WY 82002.  Interested persons may also receive a copy of the proposed rules by calling 307-777-7321, or view the proposal on line at http://agriculture.wy.gov/news/wmreg.htm/.  Any person who wishes to comment on the proposed rules shall do so in writing to the above address, Attention: Hank Uhden;

 Statement of Reasons

 The 2009 Wyoming Legislature made significant changes to the Wyoming Weights & Measures Law (W.S. 40-10-117 through 40-10-136) which became effective July 1, 2009. Based on those changes, the Wyoming Department of Agriculture is proposing to adopt new Chapter 18 rules which also incorporate the major components of three chapters of existing rules.  The following rules will therefore be repealed as a result of the consolidation: Chapter 15 – Checkweighing Prepackaged Commodities; Chapter XVIII – Specifications, Tolerances & Testing Procedures for Weighing Devices; and Chapter XX – Regulations for Registration of Weighing & Measuring Device Service Technicians.

The proposed new Chapter 18 contains definitions; technical requirements for weighing & measuring devices and checking net contents of packaged goods; certain exemptions; inspection and testing of weights and measures used commercially; registered service technicians, registration and certification of service technicians; testing and inspection fees; laboratory fees; establishment license fees; and repealing chapters.

The new regulations also adopt federal handbooks by reference that are specific to weighing and measuring devices, laboratory operations, and current industry practices.
